If someone takes the life of another out of anger they lose the right to live. The death penalty is not cruel and unusual, it would be if they killed you for something small but when it comes to murder, if you kill someone you lose the right to live. Jesus said that about adultery. It is a sin, and many in that room have sinned. But it was nothing serious, someone was married and ended up screwing another guy. Big deal, it's their personal problems not anything you should be killed for, and if Jesus allowed the killing I would think "WTF???" however like I have said, once you take the life of another innocent person who isn't trying to kill you. You lose the right to live.

And, a bit off topic. But you say the death penalty is cruel and unusual, honestly I would rather get the death penalty then a life prison sentence. As:

A: Life in prison would be boring as hell and I would be wishing I was dead. B: Have you seen those documentaries on prison gangs? Prison is like hell on earth.
